Privacy policy for the Sherpa’s Website for Developers

The Privacy Policy presented here forms part and complements the General Conditions from the Website, hereinafter referred to as the “Website”, which is owned by SHERPA EUROPE S.L. (“SHERPA”) and regulates the data processing of the Website’s users.

To be able to use all features of the Website, users must register on the Website. By completing the registration form and clicking on "Create account" to send the data, the user declares that he has read and expressly accepted the General Conditions of the Website and this Privacy Policy, and gives his unequivocal and express consent to the processing of his personal data for the purposes set out below.

It corresponds and is the obligation of the user to maintain, at all times, his or her data updated, being the user the only one responsible for the inaccuracy or falseness of the data provided and for the damages that may be caused by it to SHERPA or to third parties. SHERPA reserves the right to cancel the account of users who have provided false data, without prejudice to any other actions that may be applicable by law.

The Website offers the user many different services that allow him/her to access different Artificial Intelligence solutions developed by SHERPA. However, the present Privacy Policy refers exclusively to the processing of the data provided by the users of the Website during their registration and within the framework of the strict use of the Website. Any processing of personal data that takes place within the framework of effective access, downloading, development and integration of these AI solutions will be subject to the corresponding agreements signed in each case between the user and SHERPA depending on the AI solution used (SDKs, API, etc).

1. Personal information collected and used to register as a user of the Website

Even though certain functions of the Website may work without a previous registration, to have the ability of using all the features intended to developers the users need to complete a form in which they are required to provide a username, an email address and a password (combination of letters, numbers and symbols -minimum of 6 characters- that the user will choose and that together with a username will permit the access to the Website) as well as, if applicable, the necessary billing information. All the fields of the registration form must be filled out to have complete access to all the functions of the Sherpa Application. The users that have been registered will receive an email which will be sent to the email specified on the registration form,.

Purpose. SHERPA will process the personal information that the user provided while completing the registration form with the following purposes:

To make the use of the Website possible.

To manage the provision of the services of SHERPA, in particular, to permit the functioning of the Website as it is defined in the General Conditions, as well as billing for subscription services.

To deal with requests for information that users may make.

Where we have collected the user’s explicit consent, to send weekly messages to registered users about the new updates and functions of the Website.

The information requested is appropriate, pertinent and not excessive for the registration of the Website.

Legal basis. The legal basis of the data processing is the contractual relationship and its maintenance, as well as, the consent, which the user gives where applicable.

Retention. The personal data will be kept for the time necessary to fulfill the purposes described, as well as subsequently, where appropriate, for the fulfillment of contractual obligations and the claim of relevant legal responsibilities.

2. Links, content and third party services

The Website may contain advertisements, content, services and links to other websites. SHERPA does not control the aforementioned services, content, or websites of third parties (i.e. GitHub) and the Privacy Policy presented here does not cover the practices and policies of the aforementioned third parties in relation with the services or websites managed by them. It is recommended that the user reviews and consults the privacy policies of the aforementioned services and websites of the third parties before using them. SHERPA is not responsible for the acts and actions of the aforementioned third parties.

3. Communications about the service

SHERPA may send information related to the service of the Website to the registered users. Otherwise, SHERPA will send weekly emails with information related to the new functions and novelties of the Sherpa Application to those users which have given their consent to receive such communications.

4. Policy towards minors

The SHERPA services are designed for people over the age of 14, and so only people who are 14 or older may register as a user. Subscription services are limited to persons over 18 years of age.

5. Communication to third parties

SHERPA will not sell, give away or transmit the personal information of the users to a third party except for cases in which it is necessary and in agreement with the regulations which apply.

We inform you that the personal data may be communicated to third data processors with the sole purpose of providing us with services solely and exclusively in relation to the purposes indicated above. For example, we make billing information available to our payment service providers to enable them to manage the subscription and billing of subscription services.

Furthermore, the data may be processed and communicated in the context of actions and preparatory and reviewing acts prior to commercial operations of any nature, such as, and/or replacement in the activity, by way of example and not limitation, merger, spin-off, global assignment of assets and liabilities, contribution or transfer of business or branch of business activity, or any business and/or corporate restructuring operation of a similar nature, contemplated by the commercial regulations; as well as in the context of the aforementioned commercial operations.

6. Data subject’s rights

The user may, under the terms established in the regulations on data protection in force at any time, and in accordance with them, revoke at any time the authorization granted for the processing and transfer of personal data, as well as exercise the rights of access, rectification, deletion, opposition, right to request limitation of the processing of personal data, the right to portability, for this purpose may be addressed in writing with proof of identity by email addressed to The use of this email address is limited to carrying out the aforementioned rights, and is not established for technical service or consultation. 8. Modification of the privacy policy

SHERPA reserves the right to modify, update or revise this Privacy Policy, communicating the modification to the user at the appropriate time while asking the user to consent to the new terms. In the case that the user does not consent, he or she will not be able to continue as a user of the Website.

9. Applicable legislation

The Privacy Policy presented here, just as the General Conditions of the Website apply completely to everyone and are governed by the Spanish Law.
